GUEST RENTAL AGREEMENT

 

1) Deposit & Payment Policy:  The deposit and signed contract are due upon receipt. Verbal confirmation and total balance is due 60 days prior to arrival. 

2) Payment Terms:  Check, money order, credit card. 

3) Check-in/out: The Guest(s) acknowledges and understands that check-in time is no earlier than 3:00pm and check-out time is no later than 11:00am. These times are strictly enforced and charges may be assessed if prior approval has not been granted.  If you desire a late check out please contact our office after arrival. We are very willing to accommodate you up to 3:00 pm at no charge if the unit is available. Late checkouts may be guaranteed in advance for a half day rental fee.

4) Cancellations:  Cancellations made 60 days or more prior to arrival with written notice (fax or e-mail acceptable) shall be given a full refund minus a $100.00 cancellation fee. Cancellations of less than 60 days prior to arrival shall forfeit the entire rent and tax unless we are able to re-rent the property. Refunds on any forfeiture will be issued the dollar value the unit is re-rented for during the same dates as the cancelled reservation. There is no refund for early departure or no shows. 

5) Rates: Rates are subject to change and Hawaii State Tax. This applies only to future rentals.

Once a rental is processed rates will not change. Tax increases however will be applied.

6) Occupancy: Use of premises shall not be such as to disturb or offend neighbors or residents.  No house parties or wedding receptions are permitted. In the event a party is reported, the Agent at his/her discretion may terminate the Rental Agreement and to ask disruptive Guests to vacate the premises without refund.

7) Information: Information regarding individual listings is believed accurate but cannot be guaranteed.  Guest(s) inspection of the premises is encouraged.

8) Guest(s): Shall be solely responsible for any property damage, accident injury to any person or loss sustained by any person, including loss of money, jewelry and other items of personal property, arising out of or in any way related to Guest(s) use of the premises or the items of personal property provided by Kona Sunsets Vacation Rentals or the Owner at Guest(s) request. Guest(s) will inspect and be familiar with proper use and application of such items prior to using them. Guest(s) hereby agrees to INDEMNIFY and hold Kona Sunsets Vacation Rentals and/or Homeowner harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of premises or the items of personal property provided therein. Guest(s) assume the risk of injury or other losses relating to recreational activities and will hold Owner and Agents harmless with respect thereto. Smoking inside rental is prohibited.

9) Cleaning and Housekeeping: Guests shall leave the premises in clean, uncluttered condition. This includes cleaning dishes and returning them to their original location, appliances left clean, perishable food items removed from the refrigerator and put in available plastic bags (all items must be bagged), and all items and furniture returned to their original location. All towels and linens cleaned except for previous night and departure day use. If unit is not left in suitable condition, Guest understands that Agent reserves the right to charge the Guest for any extra or special cleaning.

10) Vacation Rental Damage Protection Plan: As part of your stay, you may purchase a $49.00 Vacation Rental Damage Protection Plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check out. If purchased, the policy will pay a maximum benefit of $1500.00. Any damages that exceed $1500.00 or are not covered under the plan will be charged to the credit card on file. If during your stay at one of our rental properties an insured person causes any damage to real or personal property of the unit as a result of any inadvertent acts or omissions, the insurer will reimburse the insured for the cost of repair or replacement of such property up to a maximum benefit of $1500.00. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy www.vacationrentalinsurance.com/g20vrd . By submitting payment for this plan you authorize and request CSA Travel Protection and Insurance Services to pay directly Kona Sunsets Vacation Rentals any amount payable under the terms and conditions of the Vacation Rental Damage. If you do not wish to purchase the Vacation Rental Damage Protection, a $1500.00 Security Deposit will be required along with balance payment 60 days prior to check in. 

11) Utilities: Unless otherwise stated, utilities and services for the premises are included except for air conditioning, which may be subject to additional fees due to abnormal usage. Due to the high costs of electricity in Hawaii we ask that Guests “Think Green” and use the A/C only when needed and turn off when not occupying the property. 

12) Supplies: A start up amenities package provided for our Guests includes: hand soap, shower soap, dishwasher soap and laundry detergent. A limited supply of toilet paper, paper towels, and trash bags. Any supplies beyond the initial start up amenities package provided by Kona Sunsets Vacation Rentals are to be supplied by the Guest.

13) Keys, Remote Controls: Keys to the premises are the exclusive property of Kona Sunsets Vacation Rentals. There will be a minimum charge of $25.00 for each lost key and $75.00 charge for lost remote controls and key cards.

14) Phone and Fax Charges: Unless otherwise stipulated, all long distance phone calls should be put on a credit or calling card. Any toll calls not charged will be assessed a $25.00 collection fee in addition to the actual charges.

15) Access to Property: Directions and Access information will be emailed within 2 weeks of arrival.
